MASTER TERMS & CONDITIONS OF SERVICE
Exclusive Services Group Inc. — DBA Exclusive Power Washing
1. Agreement to Terms
By accepting an estimate, signing digitally, approving via email or text, making payment, or allowing Exclusive Power Washing to perform services, the Client enters into a legally binding agreement with Exclusive Services Group Inc. DBA Exclusive Power Washing (“Exclusive Power Washing”).
Approval of services includes, but is not limited to:

Digital signature

Clicking “approve” in CRM
-
Email or text confirmation
-
Payment of deposit or invoice
-
Allowing service to begin
The Client confirms they are the property owner or an authorized decision-maker with full authority to approve the work. The Client authorizes Exclusive Power Washing to charge any payment method provided on file for completed services, deposits, approved additional work, or outstanding balances, without further notice once payment becomes due.
2. Scope of Terms & Conditions
These Terms govern all residential, commercial, strata, and seasonal services including, but not limited to:

Pressure washing

-
Roof cleaning and treatment
-
Gutter and eavestrough cleaning

Window cleaning
-
Concrete and paver cleaning, sanding, and sealing

Dryer vent cleaning
-
Fleet washing
-
Christmas light installation, leasing, maintenance, and removal

Any related or additional services
Exclusive Power Washing may revise these Terms from time to time.
The version provided to and accepted by the Client for the specific service shall govern that service.
Only services specifically listed in the approved estimate are included. Any additional services requested or required will be quoted separately and may result in additional charges.
3. Scheduling & Site Access
All scheduling is approximate and subject to change due to weather conditions, safety considerations, equipment issues, or operational requirements.
The Client agrees to provide:

Safe and unobstructed access to all work areas

Unlocked gates and entry points
-
Removal of vehicles from driveways and access paths
-
Removal of furniture, décor, and obstacles from patios, decks, and walkways
-
Secured pets and restricted access to children
-
Safe walking surfaces, including snow and ice removal
Failure to provide adequate access may result in:
-
Rescheduling
-
Additional labour charges
-
Partial or incomplete service
Exclusive Power Washing is not responsible for delays or incomplete work caused by restricted access.
Scheduling is subject to change due to weather, safety, access, or operational requirements. Delays do not constitute breach of contract and do not entitle the Client to discounts or cancellations.
4. Use of Water & Utilities
The Client agrees to provide:

A functioning exterior water source

Minimum adequate water pressure and flow
If the water supply is inadequate, well water is used, or connections are not readily accessible, additional charges may apply.
Exclusive Power Washing is not responsible for:

Pre-existing plumbing issues
-
Frozen, leaking, or damaged spigots
-
Low pressure systems
-
Electrical issues related to service
5. Liability for Pre-Existing Conditions
Exclusive Power Washing is not responsible for damage resulting from pre-existing conditions, including but not limited to:

Loose, brittle, rotted, oxidized, or fragile materials
-
Prior repairs or hidden defects
-
Failed seals in windows, siding, or roofing systems
-
Structural gaps, faulty construction, or building envelope issues
-
Paint oxidation, peeling, chipping, or failing coatings
-
Weak siding, trim, or deteriorated surfaces
Cleaning may reveal or worsen pre-existing conditions.
The Client acknowledges and accepts this as a normal and unavoidable risk of exterior cleaning.
All exterior surfaces are subject to age, wear, and environmental exposure. The Client accepts that cleaning may reveal or worsen pre-existing conditions.
6. General Safety & Operational Risks
Exterior cleaning involves inherent risks.
Exclusive Power Washing is not responsible for:

Slippery surfaces during or after service
-
Trip hazards from hoses, cords, or equipment
-
Debris dislodged from roofs, gutters, fascia, or siding
-
Wildlife disturbances (including bees, wasps, rodents, etc.)
The Client agrees to keep all persons, pets, and occupants away from work areas during service.
Exclusive Power Washing reserves the right to stop or delay work if conditions are deemed unsafe.
7. Inspection, Documentation & Damage Reporting
Exclusive Power Washing may perform a visual inspection prior to service. This inspection is not exhaustive.
All exterior surfaces, materials, and structures naturally deteriorate over time due to weather, UV exposure, moisture, and general wear.
The Client acknowledges that cleaning may reveal hidden defects, cosmetic inconsistencies, or material failure.
Exclusive Power Washing is not responsible for:
- Surface deterioration
- Cosmetic changes
- Material failure revealed during cleaning
- Variations in appearance after cleaning
The Client agrees to:

Report any visible concerns within 48 hours of service completion

Report hidden or non-visible concerns as soon as reasonably possible upon discovery
Exclusive Power Washing must be given a reasonable opportunity to inspect the area before any repairs, alterations, or third-party work is completed.
Failure to provide notice or inspection opportunity may limit or void claims.
8. Exterior Cleaning Acknowledgment
The Client understands that exterior cleaning may reveal or highlight:

Oxidation (chalky residue on siding)
-
Streaking or uneven coloration
-
Surface wear, fading, or aging
-
Pre-existing stains or defects
Vinyl siding oxidation may become more visible after cleaning.
Weep holes may release debris and create temporary streaking following cleaning. This is normal and not considered damage.
Exclusive Power Washing does not guarantee removal of:

Oxidation
-
Rust stains
-
Hard water stains
-
Artillery fungus
-
Deep-set or embedded staining
Water intrusion may occur in structures with compromised seals, gaps, or prior damage.
Painted or coated surfaces may be more susceptible to damage during cleaning. Exclusive Power Washing is not responsible for peeling, chipping, fading, or removal of paint or coatings. All painted surfaces are cleaned at the Client’s risk.
9. Roof Cleaning & Treatment
9.1 Service Process
Roof cleaning may include:

Manual removal of large moss clumps to reduce load on shingles

Application of a professional treatment designed to kill moss, algae, and lichen at the root
9.2 Expected Results
The Client understands:

Results are not immediate
-
Moss, algae, and lichen may remain visible temporarily after treatment
-
Natural weathering (rain, sun, wind) will remove dead growth over time
9.3 Visual Changes
After treatment:
-
Moss may turn white or brown and shrink
-
Lichen may leave root marks or staining
-
Brown or light areas may appear — this indicates dead organic growth
9.4 Timeframe
Clients should allow:

Minimum 6–8 weeks for visible improvement
-
Longer for heavily affected roofs
9.5 Roof Condition Disclaimer
All roofs respond differently depending on:

Age
-
Material type
-
Installation quality
-
Existing damage
Exclusive Power Washing is not responsible for:

Granule loss
-
Brittle or aging shingles
-
Exposed defects
-
Discoloration from prior conditions
10. Two-Year Moss-Free Roof Warranty
Applies only if:

Entire roof was treated
-
Proper maintenance is followed
Warranty is void if:

Trees or branches overhang within 5 feet
-
Gutters are clogged
-
Debris accumulates
-
Poor drainage exists
Warranty is capped at the original service value.
11. Gutter Cleaning & Warranty
Scope of Work
Includes:

System Limitation
All warranties apply only to:

Above-ground downspouts
Does NOT include:

Underground drainage systems

Buried downspouts

Warranty Terms
6-month limited warranty applies only if:

Invoice is paid in full

No external contributing factors exist
12. Window Cleaning
Methods
Water-fed pole system and traditional cleaning methods may be used.
Service Includes

Limitations
No guarantee for:

Glass Defect Disclaimer
Glass may contain pre-existing defects such as fabrication debris.
Cleaning may expose these defects.
Exclusive Power Washing is not responsible for:

Scratching caused by pre-existing defects

Damage to compromised glass
Customer Responsibilities

Clear access to all windows
-
Remove obstructions
-
Ensure screens are accessible
13. Concrete, Paver, Sanding & Sealing Services
For all hardscape cleaning, restoration, sanding, and sealing services provided by Exclusive Power Washing, the Client acknowledges and agrees to the following:
13.1 Nature of Surfaces & Pre-Existing Conditions
Concrete, pavers, and hardscape surfaces are porous, aging materials that are highly affected by environmental exposure, installation quality, and prior maintenance.
The Client understands that surfaces may contain:

Cracks, fractures, or structural movement
-
Settling, shifting, or uneven surfaces
-
Efflorescence (white mineral deposits)
-
Oil stains, rust stains, tire marks, or deep-set contaminants
-
Previous sealers, coatings, or chemical treatments
-
Discoloration due to UV exposure, moisture, or wear
-
Improper installation or base failure
Cleaning may expose, highlight, or worsen the appearance of these conditions, which is normal and not considered damage.
13.2 Cleaning Process & Surface Reaction
Pressure washing and surface cleaning are designed to remove contaminants; however:

Different areas may clean unevenly
-
Previously covered or shaded areas may appear different after cleaning
-
Heavily soiled areas may not fully restore
-
Surface inconsistencies may become more visible
The Client acknowledges that uniform appearance is not guaranteed.
13.3 Joint Sand Removal & Stability
Cleaning of paver systems will often result in the removal or displacement of joint sand.
The Client understands and accepts:

Loss of joint sand is normal during cleaning
-
Re-sanding is strongly recommended following cleaning
-
Failure to re-sand may result in:
-
Paver movement or shifting
-
Weed growth
-
Ant infestation
-
Loss of structural stability
-
Exclusive Power Washing is not responsible for any issues resulting from loss of joint sand or failure to re-sand.
13.4 Re-Sanding (If Performed)
If re-sanding services are included:

Sand will be applied based on surface condition and weather conditions
-
Proper compaction and settling may take time
-
Weather (rain, wind) may affect final results
Exclusive Power Washing does not guarantee:

Full joint stabilization immediately after service
-
Long-term joint performance
13.5 Sealing Services & Expectations
If sealing services are performed, the Client acknowledges:

Sealer results vary depending on surface condition, porosity, age, and prior treatments

Sealer may:
-
Darken or enhance colour
-
Create a glossy, satin, or natural finish
-
Highlight imperfections, repairs, or inconsistencies
-
Exclusive Power Washing does not guarantee:
-
Uniform appearance
-
Exact colour outcome
-
Consistency across all areas
13.6 Sealer Performance & Longevity
Sealer performance is affected by:

Weather conditions
-
Surface preparation
-
Drainage
-
Foot traffic and vehicle traffic
-
Environmental exposure
Exclusive Power Washing does not guarantee:

Specific lifespan of sealer
-
Resistance to wear, fading, or breakdown
-
Protection against all stains
13.7 Slip Hazard Disclaimer
Sealed surfaces may become more slippery when wet, particularly in:

Shaded areas
-
High-moisture environments
-
Sloped surfaces
The Client assumes full responsibility for:

Slip risks
-
Safety of occupants and guests
13.8 Stain Removal Limitations
Exclusive Power Washing does not guarantee the removal of:

Oil stains
-
Rust stains
-
Efflorescence
-
Paint, gum, or embedded contaminants
-
Organic staining
Some stains may be permanent or only partially removable.
13.9 Surface Damage & Material Failure
Exclusive Power Washing is not responsible for:

Etching or marking on weak or deteriorated concrete
-
Pitting or spalling due to age or freeze-thaw cycles
-
Surface breakdown caused by poor installation
-
Damage caused by prior coatings or sealers
-
Failure of previously repaired areas
The Client acknowledges that older or poorly maintained surfaces carry higher risk of failure during cleaning.
13.10 Drainage & Runoff
The Client is responsible for ensuring proper drainage on the property.
Exclusive Power Washing is not responsible for:

Water pooling or runoff issues
-
Drain backups or overflow
-
Movement of debris or sand due to water flow
-
Staining caused by drainage patterns
13.11 Weather & Environmental Conditions
Cleaning and sealing services are weather-dependent.
Exclusive Power Washing is not responsible for:
-
Delays due to weather
-
Changes in appearance caused by weather conditions
-
Sealer performance affected by rain, humidity, or temperature
13.12 Access & Site Preparation
The Client agrees to:

Remove all vehicles, furniture, and items from the service area
-
Provide clear access to all surfaces
-
Protect or remove sensitive items
Failure to prepare the site may result in:
-
Additional charges
-
Incomplete service
-
Delays
13.13 No Guarantee of Restoration
Concrete and paver cleaning is a restoration service, not a replacement service.
Exclusive Power Washing does not guarantee:
-
“Like-new” results
-
Full restoration of heavily damaged or stained surfaces
13.14 Liability Limitation
To the maximum extent permitted by law:
Exclusive Power Washing’s total liability is limited to the value of the service provided.
Exclusive Power Washing is not liable for:
-
Cosmetic dissatisfaction
-
Pre-existing conditions revealed during cleaning
-
Indirect or consequential damages
13.15 Sealer Cure & Environmental Risk
The Client acknowledges that sealing performance is highly dependent on environmental conditions at the time of application and during curing.
Exclusive Power Washing is not responsible for:
- Improper curing due to weather changes
- Moisture-related issues
- Whitening, hazing, bubbling, or uneven finish
- Sealer failure caused by prior coatings or contaminants
13.16 Acknowledgment
By proceeding with services, the Client confirms:

They understand the nature and limitations of concrete and paver cleaning and sealing
-
They accept the risks associated with surface conditions
-
They agree to all terms outlined in this section
14. Painted & Coated Surfaces
Exclusive Power Washing is not responsible for:
-
Peeling
-
Chipping
-
Fading
-
Coating failure
15. Cameras & Electronics
Clients must remove or protect all sensitive equipment.
No liability if left exposed.
16. Client Responsibilities
Client agrees to:
-
Remove delicate items
-
Disclose known issues
-
Identify sensitive surfaces
-
Provide access
17. Pricing, Deposits & Payments
Payment Terms (Residential & Standard Services)
Payment is due in full immediately upon completion of service unless otherwise agreed to in writing.
The Client agrees that:
• An invoice will be issued upon completion of the work
• Payment must be made the same day
• Failure to make payment constitutes a breach of this Agreement
If a payment method is on file, the Client authorizes Exclusive Power Washing to charge the balance without further notice once the service is completed or the invoice becomes due.
No Delay in Payment
The Client may not delay or withhold payment due to:
• Not being present at the property
• Requesting a later review
• Minor concerns or touch-ups
• Waiting on third-party approval
• Personal scheduling conflicts
All invoices remain due as agreed regardless of these factors.
If the Client has any concerns with the service, they must notify Exclusive Power Washing within 48 hours in accordance with the Damage Reporting Timeframe. This does not delay or exempt the Client from payment obligations.
Deposits
Deposits & Material Allocation
Deposits are used to secure scheduling, labour, equipment, and materials.
The Client acknowledges that materials may be purchased or reserved specifically for their project.
In the event of cancellation:
- Deposits may be partially or fully non-refundable
- Restocking fees, supplier charges, and labour costs may apply
- Custom or special-order materials may not be refundable
Net 30 / Net 60 Payment Terms (Commercial & Strata Only)
Extended payment terms (Net 30 or Net 60) are available strictly for approved commercial, strata, and property management clients and must be confirmed in writing by Exclusive Power Washing prior to service.
Unless otherwise approved in writing, all invoices are due immediately upon completion of service.
For approved accounts:
• Payment is due within thirty (30) or sixty (60) calendar days from the invoice date, as agreed
• Full payment is required; partial payments do not satisfy the account unless approved in writing
Late Payments:
• Overdue balances are subject to interest at a rate of 1.5% per month (18% annually)
• Administrative fees, collection costs, and legal fees may be added to the outstanding balance
• Accounts exceeding agreed payment terms may be suspended or sent to collections without further notice
Service Suspension:
Exclusive Power Washing reserves the right to:
• Pause or cancel ongoing or scheduled services for overdue accounts
• Refuse future service until balances are paid in full
Revocation of Terms:
Net 30 or Net 60 privileges may be revoked at any time due to:
• Late payments
• Payment disputes
• Credit risk concerns
All future services will revert to due upon completion terms.
No Withholding of Payment:
The Client may not withhold payment due to:
• Dissatisfaction with results
• Delays caused by weather or scheduling
• Internal approval processes
• Third-party disputes
All invoices remain payable in full as agreed.
If the Client is acting on behalf of a company, strata, or organization, the individual approving services confirms they are authorized to do so and may be held responsible for ensuring payment is made.
Card on File Authorization
Client authorizes Exclusive Power Washing to charge stored payment methods for:

Completed services

Deposits
-
Additional work
-
Fees and charges
Charges may be processed once services are complete or invoices are due.
18. Late Payments

1.5% monthly interest
-
Collection costs apply
-
Services may be suspended
19. Referral Program
Referral rewards may be offered at the discretion of Exclusive Power Washing.
Conditions:
- Reward is issued only after the referred job is completed and fully paid
- Referral must be disclosed at or before booking
- Rewards are non-transferable and not redeemable for cash
- Exclusive Power Washing reserves the right to modify or cancel the program at any time
20. Dryer Vent Cleaning Services
For all dryer vent cleaning services provided by Exclusive Power Washing, the Client acknowledges and agrees to the following:
20.1 Scope of Work
Dryer vent cleaning services are intended to remove lint, debris, and blockages from the accessible portions of the dryer vent system to improve airflow and reduce fire risk.
This service may include:

Cleaning from the exterior exhaust point to the back of the dryer
-
Cleaning of accessible vent lines
-
Cleaning of the internal dryer vent trap (when safely accessible)
-
Basic airflow improvement
Exclusive Power Washing does not guarantee complete cleaning of inaccessible or concealed sections of the vent system.
20.2 Customer Responsibilities
The Client agrees to:

Provide safe and clear access to the dryer and vent system
-
Move the appliance in advance if required, unless otherwise arranged
-
Remove any obstructions from the work area
-
Ensure pets and children are kept away from the work area
If the dryer is not accessible, service may be:
-
Limited to accessible areas only
-
Rescheduled
-
Subject to additional charges
20.3 Appliance Movement & Access Risks
The Client acknowledges that moving appliances carries inherent risk.
Exclusive Power Washing:

Does not disconnect or reconnect gas, electrical, or water lines
-
Does not unstack or lift stacked units beyond safe limits
-
Does not assume responsibility for tight or restricted installations
If assistance is provided in moving the appliance, it is done:

Exclusive Power Washing is not responsible for:

Damage to flooring
-
Damage to walls, trim, or cabinetry

Damage to hoses, connections, or fittings

Leaks or failures caused by shifting or moving the appliance
20.4 Pre-Existing Conditions
Exclusive Power Washing is not responsible for issues related to:

Improper or outdated vent installation
-
Crushed, disconnected, or deteriorated ducting
-
Excessively long or complex vent runs
-
Hidden defects within walls, ceilings, or floors
-
Brittle or aging vent materials
If any issues are identified, the Client may be advised to contact a licensed HVAC or appliance technician.
20.5 Hidden Hazards & System Limitations
The Client understands that dryer vent systems may contain hidden hazards including:

Pest infestations
-
Bird nests
-
Mold or moisture buildup
-
Obstructions within concealed ducting
-
Structural or installation deficiencies
Exclusive Power Washing is not responsible for:
-
Conditions discovered during or after service
-
System failures due to pre-existing issues
-
Continued poor airflow due to inaccessible blockages
20.6 Unsafe or Unsanitary Conditions
Exclusive Power Washing reserves the right to refuse, stop, or reschedule service if unsafe or unsanitary conditions are present, including:

Pest infestations
-
Mold or hazardous materials
-
Unstable or unsafe flooring
-
Exposed wiring or unsafe electrical connections
-
Dryer placement preventing safe access
A service call or assessment fee may still apply.
20.7 No Guarantees or Warranties
While dryer vent cleaning reduces fire risk and improves airflow, Exclusive Power Washing does not guarantee:

Complete removal of all lint or debris
-
Prevention of future dryer fires
-
Appliance performance or efficiency
-
Compliance with building codes
-
Long-term system performance
All services are performed using reasonable care and industry-standard practices.
20.8 Damage Disclaimer
Exclusive Power Washing is not responsible for:

Damage caused by pre-existing weaknesses or improper installations
-
Failures of brittle or aging vent components
-
Damage caused by moving appliances
-
Failures occurring after service
-
Leaks or disconnections discovered post-service
The Client acknowledges that older or poorly installed systems carry a higher risk of failure.
20.9 Recurring Blockages
Exclusive Power Washing is not responsible for recurring lint buildup caused by:

Improper vent design
-
Excessive vent length or bends
-
Poor airflow systems
-
Use of incompatible materials
Regular maintenance may be recommended but not guaranteed to resolve systemic issues.
20.10 Payment Terms
Payment is due:

Upon completion of service
-
Or as otherwise agreed in writing
Accepted payment methods include:
-
Cash
-
Debit or credit card
-
Approved electronic payment platforms
If a card is on file, the Client authorizes Exclusive Power Washing to process payment once service is completed or the invoice becomes due.
20.11 Cancellation & Access Fees
Cancellations or rescheduling requests must be made with reasonable notice.
Failure to provide access or late cancellations may result in:

Service call fees

Cancellation charges
-
Rebooking delays
20.12 Liability Limitation
To the maximum extent permitted by law:
Exclusive Power Washing’s total liability is limited to the value of the service performed.
Exclusive Power Washing is not liable for:

Fire damage
-
Appliance failure
-
Property damage related to vent system issues
-
Indirect or consequential damages
Exclusive Power Washing does not guarantee prevention of dryer fires or appliance failure.
20.13 Acknowledgment
By proceeding with dryer vent cleaning services, the Client confirms:

They understand the scope and limitations of the service
-
They accept the risks associated with appliance movement and system condition
-
They agree to all terms outlined in this section
21. Christmas Light Installation, Leasing, Maintenance & Removal
For all seasonal lighting services provided by Exclusive Power Washing, the Client acknowledges and agrees to the following:
21.1 Scope of Work
Exclusive Power Washing provides a full-service seasonal lighting program which may include:

Leasing of commercial-grade LED lighting and all required materials
-
Custom design and layout (if applicable)
-
Professional installation
-
Seasonal maintenance (as outlined below)
-
Removal of lighting in January (weather permitting)
-
Off-season storage of leased materials
All materials supplied remain the exclusive property of Exclusive Power Washing.
21.2 Design & Approval Responsibility
The Client is responsible for reviewing and approving all aspects of the lighting design prior to installation, including:

Colours
-
Bulb types and sizes
-
Layout and placement areas
-
Rooflines, trees, pathways, and structures to be included
Failure to review and confirm details prior to installation may result in outcomes that differ from expectations.
Any changes requested after installation may result in:

Additional labour charges
-
Material adjustments
-
Return visit fees
21.3 Property & Electrical Requirements
The Client agrees to provide:

Safe and stable installation surfaces
-
Clear access to all installation areas
-
Functioning, code-compliant exterior electrical outlets
-
GFCI-protected circuits where required
The Client acknowledges:
-
Their electrical system must be capable of handling seasonal lighting loads
-
Exclusive Power Washing does not guarantee against electrical overload, breaker trips, or system limitations
Exclusive Power Washing assumes the property meets all applicable electrical standards.
21.4 Ownership of Materials
All lighting materials, including but not limited to:

Lights
-
Bulbs
-
Extension cords
-
Timers
-
Clips and fasteners
remain the sole property of Exclusive Power Washing.
The Client agrees not to:

Remove
-
Modify
-
Reposition
-
Tamper with
any installed lighting system.
Unauthorized interference may result in:

Additional charges
-
Loss of maintenance coverage
-
Liability for damaged or missing materials
21.5 Maintenance Program
Seasonal maintenance includes reasonable service calls for issues related to:

Loose or fallen lights
-
Faulty connections
-
Product defects
Maintenance does NOT cover:
-
Weather-related damage (wind, snow, ice, storms, extreme cold)
-
Animal or pest damage
-

21.7 Installation Conditions & Safety
Exclusive Power Washing reserves the right to:

Adjust installation methods to maintain safety standards
All work is performed in accordance with industry best practices.
21.8 Scheduling & Removal
Installation and removal dates are:

21.9 Payments & Deposits

A 50% non-refundable deposit is required to secure installation

21.10 Non-Payment & Right of Entry
If payment is not received:

By agreeing to these Terms, the Client grants Exclusive Power Washing a limited license to access the property for the purpose of retrieving company-owned materials in cases of:

Non-payment

21.11 Damage, Loss & Replacement
The Client is responsible for the cost of repair or replacement of any materials damaged due to:

Misuse

Tampering

Negligence

Theft

Acts of God
21.12 Liability Limitations
Exclusive Power Washing is not liable for:

To the maximum extent permitted by law:

21.13 Photo & Video Authorization
The Client authorizes Exclusive Power Washing to capture and use photos or videos of the installation for marketing and promotional purposes.
No personal identifying information will be disclosed without consent.
21.14 Cancellation Policy
If the Client cancels:

Deposits remain non-refundable.
No refunds will be issued for completed or partially completed work.
21.15 Acceptance of Terms
By proceeding with services, the Client confirms:

21.16 Permanent Lighting Installation (Year-Round Systems)
Exclusive Power Washing may offer installation of permanent exterior lighting systems (“Permanent Lighting”) designed for year-round use. By proceeding with permanent lighting services, the Client acknowledges and agrees to the following:
21.16.1 Nature of Permanent Lighting Systems
Permanent lighting systems are:

Fixed installations attached to the structure

Intended for long-term use across multiple seasons
-
Exposed to weather, UV, temperature changes, and environmental conditions
Unlike seasonal lighting, these systems:

👉 May require permanent fastening, clips, or mounting systems
21.16.2 Installation Methods & Property Impact
Installation may involve:

Drilling into soffits, fascia, trim, or other exterior components

Use of clips, brackets, adhesives, or fasteners

Routing and securing electrical wiring along the structure
The Client acknowledges:

Minor cosmetic changes may occur to the property

Small holes, marks, or fastener points are considered normal and necessary

Installation methods are selected based on safety, structure, and product requirements
Exclusive Power Washing is not responsible for:

Cosmetic impact from installation

Visibility of wiring or clips

Differences in finish where materials are installed
21.16.3 Electrical Requirements & Limitations
The Client is responsible for:

Providing safe, functional, and code-compliant electrical supply

Ensuring circuits can handle the lighting system load

Maintaining electrical infrastructure
Exclusive Power Washing:

Does not certify or upgrade electrical systems

Does not guarantee compatibility with all homes or panels

Is not responsible for electrical overloads, breaker trips, or wiring issues
21.16.4 Product Performance & Limitations
Permanent lighting systems are subject to:

Weather exposure (rain, snow, ice, UV)

Temperature fluctuations

Wear over time
Exclusive Power Washing does not guarantee:

Exact color consistency over time
-
Resistance to fading or weathering
-
Lifespan beyond manufacturer expectations
21.16.5 Maintenance & Repairs
Unless otherwise stated in writing:

Repairs, troubleshooting, or service calls are billed separately
Exclusive Power Washing is not responsible for:

Product failure after installation

Wear and tear over time

Environmental damage
21.16.6 Third-Party or Manufacturer Warranty
Any warranties on permanent lighting systems:

Are provided by the manufacturer, not Exclusive Power Washing

Must be handled directly with the product supplier unless otherwise stated
Exclusive Power Washing makes no independent warranty unless clearly outlined in writing.
21.16.7 Customer Misuse or Alteration
The Client agrees not to:

Tamper with installed components
Any unauthorized changes:

Release Exclusive Power Washing from all liability
21.16.8 Damage, Failure & Liability

21.16.9 Removal of Permanent Lighting
Permanent lighting is considered a fixed installation.

21.16.10 Sale vs Lease Clarification

21.16.14 Acknowledgment
By proceeding with permanent lighting installation, the Client confirms:

22. Strata & Property Management Responsibilities
For any services performed at strata properties, townhome complexes, multi-unit buildings, or managed properties, the Client (including but not limited to strata councils, property managers, or authorized representatives) acknowledges and agrees to the following:
22.1 Responsibility for Communication
The strata council, property manager, or authorized representative is solely responsible for communicating all service-related information to residents, tenants, and occupants.
This includes, but is not limited to:

Scheduled service dates and approximate timeframes
-
Areas that will be serviced
-
Required preparation instructions
-
Access requirements
-
Safety notices and precautions
Exclusive Power Washing is not responsible for any failure, delay, or miscommunication between the strata/property management and residents.
22.2 Resident Preparation Requirements
It is the responsibility of the strata/property management to ensure residents properly prepare their units and surrounding areas prior to service.
This includes, but is not limited to:

Removing all personal belongings from service areas
-
Clearing patios, decks, balconies, walkways, and entryways
-
Removing or securing outdoor furniture, décor, and valuables
-
Closing all windows and doors
-
Removing or protecting sensitive items, electronics, and fixtures
-
Removing window screens where applicable (unless otherwise arranged in writing)
-
Ensuring pets and children are kept away from work areas
-
Providing safe and unobstructed access to all required service areas
Failure to properly prepare units may result in:
-
Skipped or incomplete service areas
-
Additional labour charges
-
Return trip fees
-
Delays in project completion
Exclusive Power Washing is not responsible for any damage or issues resulting from failure to properly prepare the property.
Exclusive Power Washing is not responsible for any failure by strata, property management, or residents to comply with preparation, access, or communication requirements.
22.3 Access & Entry Requirements
The strata/property management is responsible for ensuring:

Access to all required units, buildings, and common areas
-
Gates, pathways, and entry points are unlocked and accessible
-
No obstructions prevent safe access for equipment and technicians
Exclusive Power Washing is not responsible for missed or incomplete service due to lack of access.
22.4 Unit Refusal, Non-Compliance & Missed Areas
If individual residents:

Refuse service
-
Do not provide access
-
Fail to properly prepare their unit
-
Interfere with or delay service
Exclusive Power Washing is not responsible for incomplete or skipped service in those areas.
Return visits to complete missed units will be subject to additional charges and scheduling availability.
22.5 Assistance with Communication
Exclusive Power Washing may, under agreed circumstances, assist with communication by providing notices, templates, or reminders.
However:
👉 Final responsibility for communication, coordination, and compliance remains solely with the strata council or property management at all times.
22.6 Multi-Unit Environment Risks & Liability
Due to the nature of multi-unit properties, the Client acknowledges and agrees that Exclusive Power Washing is not responsible for:

Items left in service areas by residents
-
Personal belongings not removed or properly secured
-
Water intrusion caused by open windows, doors, or pre-existing building issues
-
Damage resulting from resident negligence or non-compliance
-
Interference from residents, guests, tenants, or third parties during service
-
Movement of debris between units caused by cleaning processes
The Client understands that multi-unit environments introduce variables beyond the control of Exclusive Power Washing.
22.7 Scheduling, Phasing & Project Flow
Strata and multi-unit projects may be completed in phases.
The Client acknowledges:

Scheduling may shift due to weather, safety, or operational requirements
-
Certain buildings or units may be completed at different times
-
Access limitations may affect workflow and timing
-
Completion timelines are estimates only and not guaranteed
22.8 Shared Responsibility Acknowledgment
The Client acknowledges that successful completion of strata or multi-unit services depends on cooperation between:

Exclusive Power Washing

Property management or strata council
-
Individual residents
Exclusive Power Washing is responsible only for the services performed and not for the actions, inactions, or compliance of residents or third parties.
23. Liability Cap
To the maximum extent permitted by law, Exclusive Power Washing’s total liability for any claim, damage, or loss arising from services provided is strictly limited to the total amount paid by the Client for the specific service in question.
24. No Consequential or Indirect Damages
Exclusive Power Washing is not liable for any indirect, incidental, or consequential damages, including but not limited to:

Loss of use
-
Loss of income or rental revenue
-
Business interruption
-
Mold growth
-
Interior or hidden water damage
-
Post-cleaning staining or discoloration
25. Damage Disclaimer & Limitation
Exclusive Power Washing takes reasonable care in performing services; however, the company is not responsible for damage resulting from:

Pre-existing conditions
-
Faulty construction or materials
-
Improper installation of surfaces or systems
-
Natural deterioration of materials
-
Conditions beyond the company’s control
Damage will only be considered the responsibility of Exclusive Power Washing if directly caused by proven negligence.
26. Environmental Compliance
Exclusive Power Washing follows industry best practices and applicable local regulations regarding wastewater, runoff, and chemical use.
The Client agrees to:

Ensure compliance with any site-specific environmental requirements

Accept responsibility for any restrictions related to the property
27. Indemnification
The Client agrees to indemnify, defend, and hold harmless Exclusive Power Washing, its owners, employees, and contractors from any claims, damages, losses, or expenses arising from:

Failure of the Client to comply with these Terms

Conditions on the property outside the company’s control
-
Actions of third parties, tenants, guests, or contractors
-
Use or condition of the property
28. Damage Reporting Timeframe
The Client must report any concerns, deficiencies, or alleged damage within forty-eight (48) hours of service completion.
Failure to report within this timeframe constitutes full acceptance of the work performed and waives any claims against Exclusive Power Washing.
No claims will be considered after this period unless otherwise required by law.
29. Dispute Resolution
In the event of a dispute, both parties agree to attempt to resolve the matter through good-faith communication.
If resolution cannot be reached, the matter shall be resolved through binding arbitration in Surrey, British Columbia, unless otherwise required by law.
Each party is responsible for their own legal costs unless otherwise determined by the arbitrator.
30. Force Majeure
Exclusive Power Washing is not liable for delays or failure to perform services due to events beyond reasonable control, including but not limited to:

Weather conditions

Natural disasters
-
Government restrictions
-
Illness or injury
-
Mechanical failure
-
Supply chain disruptions
-
Utility outages
Such events do not constitute breach of contract.
31. Governing Law
These Terms and all services provided are governed by the laws of the Province of British Columbia, Canada.
Any legal proceedings shall be conducted within this jurisdiction.
32. Severability
If any provision of these Terms is found to be invalid or unenforceable, all remaining provisions shall remain in full force and effect.
33. Entire Agreement
This document constitutes the entire agreement between the Client and Exclusive Power Washing.
No verbal statements, representations, or prior agreements shall modify or override these Terms unless agreed to in writing.
34. Acknowledgment & Acceptance
By approving an estimate, making payment, or allowing work to begin, the Client acknowledges that they:

FINAL ACKNOWLEDGMENT
34. Acknowledgment & Acceptance
By approving an estimate, signing digitally, responding via email or text, making payment, or allowing Exclusive Power Washing to begin work, the Client acknowledges and agrees that:
• They have read, understood, and accepted all Terms and Conditions in full
• They have had the opportunity to ask questions and receive clarification
• They understand the nature, risks, and limitations of exterior cleaning services
• They accept that results may vary based on surface condition, age, and environmental factors
• They agree that no verbal statements, promises, or representations alter these Terms unless confirmed in writing
The Client further acknowledges that:
• These Terms apply to all current and future services unless otherwise agreed in writing
• Failure to read these Terms does not exempt the Client from being bound by them
• Continued use of services constitutes ongoing acceptance of these Terms
This Agreement constitutes a legally binding contract between the Client and Exclusive Services Group Inc., DBA Exclusive Power Washing.
